Fierce Faith is a custom apparel and lifestyle brand owned and operated by Evelyn Hernandez, doing business as Fierce Faith. Fierce Faith designs and sells Latina-inspired graphic t-shirts and apparel products.

4. SMS Messaging Terms
A2P 10DLC Disclosure: Fierce Faith's SMS messaging program is operated in compliance with the CTIA Messaging Principles and Best Practices and applicable federal regulations, including the Telephone Consumer Protection Act (TCPA). By opting in, you consent to receive automated marketing text messages from Fierce Faith.
4.1 Program Description
The Fierce Faith SMS Updates program sends recurring automated marketing text messages to subscribers who have provided their express written consent. Messages may include new product announcements, exclusive discounts, order status updates, and brand news.
4.2 How to Opt In
You may opt in to the Fierce Faith SMS program by:
- Checking the SMS consent checkbox on our website opt-in form and submitting your mobile phone number.
- Checking the SMS consent checkbox on our contact form.
- Texting a designated keyword to our SMS number (when applicable).
4.2a Age Requirement
Our SMS program is intended for users who are 18 years of age or older. By opting in to the Fierce Faith SMS Updates program, you represent that you are at least 18 years of age. If you are under 18, you may not opt in to or use our SMS messaging service.
By opting in, you further represent that: (a) you are the authorized user of the mobile phone number provided; (b) you are at least 18 years of age; and (c) you have read and agree to these Terms and our Privacy Policy.
4.3 Message Frequency
Message frequency varies. You may receive up to 4 messages per month. Actual frequency depends on your activity and our promotional calendar.
4.4 Message and Data Rates
Message and data rates may apply depending on your mobile carrier plan. Fierce Faith is not responsible for any charges imposed by your carrier.
4.5 How to Opt Out: You may cancel your SMS subscription at any time by replying STOP to any Fierce Faith text message. After opting out, you will receive one final confirmation message confirming your unsubscription. No further messages will be sent unless you re-subscribe. You may re-subscribe at any time by opting in again through our website.
4.6 How to Get Help
For help with our SMS program, reply HELP to any Fierce Faith text message, or contact us at hello@fiercefaith.com. We will respond within 1–2 business days.
4.7 Consent Not Required for Purchase
Your consent to receive SMS messages is not a condition of any purchase. You may make purchases from Fierce Faith without opting in to our SMS communications.
4.8 Data Sharing
No mobile information, including phone numbers and SMS opt-in consent data, will be shared with or sold to third parties or affiliates for their marketing or promotional purposes. This data is used solely to operate the Fierce Faith SMS program. See our Privacy Policy for full details.
4.9 Carrier Disclaimer
Carriers are not liable for delayed or undelivered messages. Fierce Faith is not responsible for any delays or failures in message delivery caused by your mobile carrier or network conditions.
4.10 Supported Carriers
Our SMS program is available on all major U.S. wireless carriers, including but not limited to AT&T, T-Mobile, Verizon, Sprint, Boost Mobile, U.S. Cellular, and MetroPCS. Carrier support may vary.
5. Products and Orders
Fierce Faith's online shop is currently in development and will launch soon. When the shop is live, the following terms will apply to all purchases:
- Pricing: All prices are listed in U.S. dollars and are subject to change without notice.
- Payment: Payment is required at the time of purchase. We accept major credit cards and other payment methods as listed at checkout.
- Order Acceptance: We reserve the right to refuse or cancel any order for any reason, including errors in pricing or product information.
- Shipping: We ship within the United States. Shipping times and costs will be displayed at checkout.
- Returns: Our return policy will be published on the website when the shop launches. Custom or personalized items may not be eligible for return.
- Product Descriptions: We make every effort to accurately describe our products, but we do not warrant that product descriptions or other content is accurate, complete, or error-free.
6. Intellectual Property
All content on the Fierce Faith website — including but not limited to text, graphics, logos, images, designs, and software — is the property of Evelyn Hernandez, DBA Fierce Faith, and is protected by applicable copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any content from our website without our express written permission. Requests for permission may be directed to hello@fiercefaith.com.
All Fierce Faith designs are original works created by Evelyn Hernandez. Unauthorized reproduction or use of our designs is strictly prohibited and may result in legal action.
7. User-Generated Content
If you submit reviews, comments, photos, or other content to Fierce Faith (including via social media tags or email), you grant Fierce Faith a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, and display such content in connection with our business and marketing activities.
You represent that you own or have the right to submit any content you provide, and that such content does not violate the rights of any third party.
8. Disclaimer of Warranties
THE TEEVIBE WEBSITE AND ALL CONTENT, PRODUCTS, AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the website will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or usefulness of any information on the website.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, TEEVIBE AND EVELYN HERNANDEZ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE WEBSITE, OUR PRODUCTS, OR OUR SMS PROGRAM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO TEEVIBE IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
10. Indemnification
You agree to indemnify, defend, and hold harmless Fierce Faith, Evelyn Hernandez, and our agents, from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your access to or use of our website or services; (b) your violation of these Terms; (c) your violation of any third-party right; or (d) any content you submit to us.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which Evelyn Hernandez, DBA Fierce Faith, is domiciled, without regard to its conflict of law provisions.
Any dispute arising from these Terms or your use of our website or services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction for intellectual property infringement or other urgent matters.
